    How to file both 1040 and 1040NR as the dual-status for 2009 tax return?
    Hi,

    I know that this issue have been asked again and again. But I am still not getting it.

    I came to the US in 2006 on F1 until 09/30/2009. Starting from 10/01/2009, I began working on H1B. During the year 2009, I didn't leave the US for any single day.

    I know that I started the year 2009 as the non-resident alien, but ended the year 2009 as the resident alien. It seems that I should file both form 1040 and 1040NR as the dual-status alien.

    My employer only withheld and reported the Federal and State Income taxes for me when I was on F1. Starting from 10/01/2009, my employer started to withhold and report the Federal and State Income taxes with SS and Medicare and other taxes for me since I am on H1B now. But I only got one W2 form covering the whole year of 2009.

    Should I divide my income into two parts - F1 part and H1B part? File 1040NR with F1 part and file 1040 with H1B part? Is there any tax treaty, standard deduction, or itemized deduction allowed under any of the two forms?

    If you are single, file nonresident tax return.
