    Recently married, part year resident in 2 states, softward suggest we file separately
    Hi, We are recently married in November 2010, My husband has been living in virginia until we got married, and moved in with me to West Virginia, when I file my taxes, turbotax suggest we file our federal taxes jointly, and our state taxes separately. Does anyone else have any suggestion, I just want to make sure I am filing our taxes correctly

    MOST states require you file jointly if you filed that way on the federal return. However, Virginia allows filing of just one spouse if the other was never a resident of Virginia.

    Not sure how West Virginia handles it, but they should NOT tax your husband on his Virginia-based income.
