I need help I drive for a trucking company that leases trucks to a company while attempting to turn a corner a car came out of from behind a sign and I seen him at the last second and stopped, I didn't hit him but he swerved and damaged his vehicle the companies insurance didn't cover it so they passed the buck and taking it out of the settlement and my employer is taking it out of my check. Can he legally do this?

If they are taking it out of the settlement, then they don't have to take out of your paycheck.

They took it out the settlement to my boss but my boss is taking it out my check to recoop the loss

I was told that the first $2500.00 is charged back to the owner of the leased truck who I am driving for

Are you saying that the company you work for took the entire amount of the damages out of the settlement?

They can't take it out of your paycheque, joseph as well, if they already have been paid for the damages from the settlement. Is this a mickey mouse organization or what?

What is the amout, is it huge ?

Hire lawyer. They can't do this.

From what the safety director told me that is the way they have been doing it to all the drivers that are leased on to this company it was only $2489.24 but they are

The company that I am leased onto took the amount out of the settlement they sent to the company I work for or the owner operator (company)
