    How to file for Cost of living adjustment for child support?
    I would like to file for a COLA in NY. My son in will be 9 in a few months and I am currently owed for back supprt 18,000.00 He was court order to pay 50 a week and I have gotten 2 checks in the last few weeks for 75 I would like to increase these payments due to my bills and cost of living have increased greatly He has no court oreder vist or contact of any kind. Im not sure how to go about this at all I want the no contact to continue due to his reason for being in prison and lack of want to be in my son's life in the last 8 3/4 years. We have go to court in the past and I have won all but 1 case for contact I was order 4 updates every year he was to send 6 letters a year(which he did not)He has been out since August of this year and has no bothered to contact me other then through my aunt and uncle to threaten me again. I don't want contact he is not a good person even compared to the worse of the worse. I could just simply use a bit more help at this point and I am afraid that if I want a COLA that it may intitled him to vists what should I do?

    Child support in NY is by law, 17% with one child. It's not a straight 17%, however, and there are a few other "tweaks" which the Court can make.

    You can only get more money if he makes more money. Of course, if his income drops HE can go back to Court and get the support reduced.

    If he is not paying as ordered go back to Court and ask to have him held in contempt. The fact of that is that "maybe" they'll jail him. If so, he will have no income and you will get no money.

    There is no "cost of living allowance" in NY when it comes to child care. As I said, it's based on income, not expenses.

    Support and visitation are different things. Being ordered to pay support has nothing to do with visiting with the child.
