    Yes. In fact you are required to fill in the father's name if known. However, if he is not your husband and does not sign the because or an acknowledgment of paternity, you will still need to go to court and have a paternity test done to establish legal paternity.

    Again, you HAVE to list the father if known. He can take you to court to remove his name if he doesn't believe he's the father.

    The father doesn't need to be with you or even agree he is the father for you to list him on the BC, that is moms responsibility to report.

    Hmmm... No one can list whoever as a father unless
    1.The mother and the father are married
    2.The father signed Acknowledgment of paternity.
    3.There was a court procedure.

    To clarify what GV70 is saying... for a father to be put on a birth certificate you EITHER have to be married OR the father has to sign and Affidavit of Paternity.

    Without either of these you cannot put his name on the birth certificate.

    Hmmm, So if the mother is not married, the hospital or registrar will not accept a father's name without their signature? I wasn't aware of that. I was under the impression that the mother had to list the father, but if she tried to get support, a paternity test would be required. I think not listing may be a better way.

    No. To list a father a AP (Affidavit of Paternity) must be signed by the father.

    I pass the AP out to every mother who is unwed in my hospital.

    Yes-the hospital or registrar will not accept it
    If the parents are not married, the child has no legal father, and the biological father has no rights or responsibilities to the child.
    Unmarried parents can establish paternity in two ways:

    1. by signing a voluntary Acknowledgment of Paternity form; or
    2. by petitioning a court to determine paternity.
