I have a very preplexed situation. My child was born without the b/f there and then he demanded paternity test. We were never married so I gave my child my last name, when I remarried the b/f showed up in the picture. We have battaled this out in court for over two years. 1st was my relocation move, 2nd was visitation and custody. The judge allowed my move because my new husband is military. The b/f sees his child once a month until start of school. He refused to sign the birth certificate when the child was under the age of 1, but now is demanding that he be placed on the birth certificate. Although he pays child support and has been determined the father, do I have to place him on there. My child was born in Texas, court has been in Louisiana. My attorney in Louisiana said, that it was my right to leave him off if I choose as long as it is not done for fradualent reasons or I do not hender his visitation. I am tired of the battle, he has made the judge so mad, and I am tired of the continuing battles he causes. He is very bitter that I have moved on with my life, this has never been about our daughter. But about his ego. The judge has not ordered a name change or the birth certificate.

You don't place him on the B/C - a birth certificate is a legal document. The court will decide, probably without consulting you. You said he has already been determined to be the father... the B/C is just a piece of paper that puts that in a convenient form.

He will probably not be able to force a name change. The B/C he probably will be able to get his name added to.

If he goes to court about it. Which he would have to anyway since you cannot modify a legal document without a court order.

You are not REQUIRED by law to place the father on the birth certificate unless it is court ordered.
