How much to sue for ?
Years ago, I took my pregnant wife to a male Dr. They began going out to movies and cinema while I was at work. She said he was gay. After the child was born, she made him godfather and the child baptized at his church. 2 months later, she brought him to a competition I was taking part in and I had them removed. A few days later, she called the cops to remove me from our home because I was jealous of her gay Dr friend. She divorced me and a few years later married the Dr.
Recently, I asked for an audit of my hospital file at the hospital he works at and found out that he accessed my file on 2 occasions and wrote about my medical condition in a court document as well as the medications I was on. He further tried to smear me by adding that as a Dr, he knew I quit my job without cause and that I was never a champion in boxing even though I was and have magazines, newspaper articles and letter from the boxing president that prove I was. I have not been able to work and went through depression. In all, I have lost over $500,000. Even after I allowed him to adopt my 2 children, he and my ex wife still wanted $100 a month for 15 months.
    Any advice would be appreciated.

If you owed child support at the time of the adoption, you were still required to pay it. But any future obligation ended.

If the doctor accessed your medical records without permission you should report it to HIPAA.

How do you figure you lost $500K? Have you consulted an attorney?

I paid close to $150,000 for the children after the divorce and never had access as per the court order. I initially received papers from their lawyer for the Dr to adopt the children and for me to pay $400 a month. I said no and never saw my children again.

Child support and visitation are two different things. If you were ordered to pay $150K in support then you didn't lose anything. If you had court ordered visitation that was denied you, did you ask the court to hold the mother in contempt?

Once an adoption takes place your rights and responsibilities end. You would still owe arrears, but if they were asking you to continue paying, either they didn't get an adoption or they were doing something illegal.

I have no money left. The Dr, a wealthy man, is a board member at the College and was protected but I continued the fight until he was eventually given a caution for giving his medical opinion when he was not my Dr.

First you can't sue the doctor because you were not able to take ex back to court and enforce your rights,

You have to pay, even if she does not let you see them.

So you don't and can't sue for that. You also can't sue for not being able to see the kids.

The only illegal things the doctor did was look at your records, and then perhaps say a few negative things about you. The rest was more common of a divorce when one party talks bad about the other.

I would sue for about 2 million, and of course I don't think you will win. I don't even see any grounds for a case, but if you are going to sue, sue big.

I'm wondering about one number: $100/mo for 15 months = $1,500. Then you say $150,000.

Too bad you didn't have a better lawyer during the divorce, but I agree that the only part that matters now is looking at your medical records and using the info.

What a sad story. I feel for you.

I gave close to $149,000 over the years and they wanted an extra $100 a month for 15 months after I signed the adoption papers and left my job

I wasn't worried about the wife leaving me but the fact that the Dr had no fear in taking my wife out even after warning him. He then brought her to a boxing competition I was in and I had them thrown out.

I paid over $150,000 through the years for the children and haven't been able to work for 5 years now (depression). The Dr also listed my medical conditions and medication I was on. All information that I never told him.

I do think I have a case as he had no right to state his 'professional opinion' about my able to work, listing my health conditions as well as medications, when he was not my Doctor.

First, please don't use the comments feature for followups. Use the Answer options instead.

Again, if you were ordered to pay support and that support amounted to $150K and you still owed at the time of the adoption, then you owed that money and your ex was entitled to it.

So you have no cause of action over that. You may have had a contempt case for her violating the visitation order. But once you agreed to the adoption and it was finalized that became moot, so no case there.

There is seemingly a HIPAA violation for him accessing your records, but, frankly, they could have gotten a subpoena to get them as part of the divorce action.

Your depression issues may have been the result of the divorce, but that is a really hard thing to prove.

I have to agree any case you might have is very slim at best. You will NEED a good lawyer to even determine if there is a sufficient case. My suggestion is to forget it an move on. What does your therapist say?
