    Florida/ does the court have to credit you for all time served?
    In Florida do the courts have to give credit for all time served? My husband has served 46 months of his 5 year sentence, but they want to only credit him 15 months. Can they do that?

    Apparently, they can... Although, I doubt your husband spent 46 months in jail waiting trial, and that's the time served they can, or don't have to credit to him.

    If you'd like to explain your situation, I might be able to give you a better answer...

    Yes, time served is normally the time you are held before trial, *** if not held on probation hold, or held for other crimes, or serving other sentence at the same time.

    A lot more details are needed.

    Yes they can. As outlined above by Exie and Chuck just because someone was in jail does not mean it's all going to be used as "credit" by the Court.

    Please explain in more detail and we can see if there are any loopholes available.
