    Grandparent laws in MI
    Im pregnant the father is in jail his parents are saying he has rights still to say who can and can not see the baby while in jail. He's parents are herassing me can they actully go get rights to the baby even though the fathers in jail and we are no longer together

    Yes and no. How old are you? What is your current living situation?

    Yes, the father still has rights even though he is incarcerated. He'll eventually be released and owe back child support. Based upon what he's incarcerated for, he may or may not be allowed visitation with the child.

    When the baby is born, and the father is released from custody, he very well might have rights to visitation, etc. But that doesn't mean that the grandparents automatically have visitation rights apart from those of their son.

    In many states grandparent visitation rights are specified by statute. Which state are you in?

    Michigan passed a new law a few years ago. You can find out more about that law here:

    Based on this it would appear the grandparents can get visitation if the father is declared the legal father and pays support.

    He's in jail for rape of a minor. And I'm 18 and living situation is the same as everyone at the moment money wise not the best but got a house and tons of family that loves me

    Even if he's in for rape of a minor?? And getting between 40months to 30 years. He finds out this week how long he gets. I'm in Michigan
