I am the Administrator of my mothers will, my sisters have signed releases to the house that mother and I bought together. Mom is gone, I need to refinance the loan but must have my name added to the Title. I don't think this is a Quit Claim Deed situation, but I'm not sure. Can you help?

It would be done though probate, since your name was not on it prior to mothers death ( you state you and mom bought it together ?) so was your name not already on it ?

But the probate judge will sign off a new deed your attorney presents to them. The releases of the other heirs will clear it to go to you.

The only difference between a QCD and a warranty deed is that, if it's a QCD, the grantor is not liable to the grantee if it turns out the grantor had less than perfect title. In other words, if you sign a QCD conveying my property to someone else, and it that someone else later discovers it was my property, not yours, the grantee could not sue you. So, a QCD would work.

You are administrator of your mother's will. Is that the same as what is called an executor or personal representative in most states? Has the will been admitted to probate?

Interesting answer, I was not even aware of a warranty deed. To answer your question, yes, administrator is one in the same as Executrix. I wonder if there is a difference between Florida and Texas laws regarding this matter. I thank you.

Though my attorney has a release in writing from one sister, the other claims no right, but has never submitted a release and most likely will not after this long of a time. She just doesn't care
