    Teacher harassing my 12 year old daughter and has been stalking me for some time
    My 12 year olds science teacher has been harassing her during normal school hours. She has been pulled to a separate room to be questioned by the teacher over matters of the family or just about her father (me) My daughter is failing her class only and hates school now. Honor roll student at that, this teacher also has been stalking me for a few years now. Taking pcitures, riding around where I live, riding around family restaurant and just last week was caught riding around our rehearsal dinner. I am fearful for my daughter and the consequences later in life. This is a catholic school teacher, she is a female. I have gone to the principle, she said basically; (you know how 12 yearolds are) quote! I have turned it in to the police for stalking, but should I get an attorney for my child's case? This teacher has had numerous parents complain about her for a lot of years and nothing is ever done.

    If you have filed criminal charges against this teacher are they being prosecuted? If so, you go to the principal and demand the teacher's suspension pending resolution of the charges. No school is going to allow a teacher in the classroom while there are pending charges.

    Scott, tahnks for reply. No criminal charges yet due to gettting the right attorney. Savnnah is tough small town with huge catholic base. Called a few attorneys and no one has jumped. I had a police friend due the record for a case and a detective will be asigned for the stalking, but I really need someone for the child. I have called the catholic diocese and yet no return call.

    You stated you reported the stalking to the police. Its up to the police or the local District Attorney/prosecutor to prosecute criminal charges NOT you. So your finding an attorney has no bearing.

    So you first need to get a statement from the detective assigned to the case that there is a pending investigation. You then take that document to the principal.

    I don't know if the catholic priest pedophile scandal reached your town. If it DID, there IS a local attorney who represented the victims... Hire HIM.

    That's of course up to you. Assuming that money's no object, it never hurts to hire an attorney. :D

    But I don't really know why she would really need one at this point: she doesn't appear to be a suspect in any criminal activity, I don't see significant damages, frankly, which would warrant a lawsuit against the teacher, the school, or the diocese. As ScottGemm suggests, the school might want to suspend the teacher pending an investigation, but I don't think it is legally required to do so.

    You have said that no locally attorney has jumped at the chance to represent you and your child. They probably see no money in it. An attorney would, I suspect, want a retainer up front, as well as clear marching orders: what is he/she supposed to do? One thing I can think of is working with the school and parents to develop good policies governing teacher conduct. A teacher pulling a student into a separate room to be questioned, especially about non-school-related matters, is one thing such policies might want to address.

    It would help to have at least some sense of the nature of the reasons the teacher uses for talking privately with her, and what you feel is the basis for the stalking, and what the other parental complaints you mention were about. What comes to mind is her belief that you are abusive to your daughter and that this teacher makes it her mission to go after every parent whose child says some typical (or atypical) remark about 'he's so mean' or 'I hate him.' You mention a rehearsal dinner, suggesting that you were a single parent getting remarried, or is that an older child... anyway, none of this changes how you deal with it of course, unless you haven't had a heart to heart with your daughter, who might be able to clear a lot of this up.
