Guardianship
Hi I am 25yrs old I have son who will be turning 3yrs old in October last November my parents took me to court to get guardianship of my son as payback for me getting my mom arrested for assualting me... the judge gave them guardianship because he said I was finicially unstable... I had my own place paid my own bills my son had food clothing shelter and a lot of toys if I can do all that how is being financially unstable. None the less I have previously moved in w my boyfriend who I have been w for 5 months my parents and my son both like him a lot I was needing to know if anyone knew of a cheap attorney that deals with guardianship in springfield Missouri... I can't afford much but my son means the world to me and I want him home where he belongs and he wants to come home so bad every time I see him he says, "Mommy i go with you?" and its heartbreaking plus hearing him cry for me a block away is very heartbreaking as well... please someone help us... thanks

You can contact your local bar association and they can recomed someone. But in all honesty there is no "cheap" lawyers. If you don't make a lot you might try to use a public system for help but you don't always get the full representation you deserve.

One place to check is a local law school. Some have clinics to help in cases like this.
But frankly, I have to believe there is more to this then you are saying. Courts are reluctant to remove a child from the natural parents. It seems unlikely that a judge would remove your child under the circumstances you indicate.

ScottGem you don't have to believe me but that is what the judge told me. He also wanted me off tanif (cash assistance through dfs), have a better paying job or go back to school. I am epileptic and have limited availability. I can't drive. That's what judge Waters said. Legal aid denied me.

What's a public system? Never heard of one... is it true that if I get married that I can get my son back?

See like I said, there is more to this then you were saying. Now you tell us you were on public assistance. This makes your story make more sense. Since your parents offered to care for the child without it costing the taxpayer, while your continued care would have meant costing the taxpayer, its more understandable. So your son had "a lot of toys", yet you were living off the state!
You need to get your act together, either get a job or marry the boyfriend and get off the public dole. Then apply to have your child returned.

Scottgem so your saying that if my boyfriend and I do decide to get married I can get my son back? I am on medical leave right now that is why I don't have a job. I don't plan on fight until the end of the school year because I want him to finish pre-school. I live in a different town than he does. So I'm just thinking of him...

I'm saying that you stand a better chance if you show the court more stability.
