    My dad passed away and we have to sell the house. But my nephew refuses to leave.

    So, EVICT him. It'll only take about 3 weeks if you and your courts are efficient.

    Well it will probably take a bit more than 3 weeks, since you will probably need to give him 30 days WRITTEN notice to vacate. If he still won't budge, then you file for an eviction order. In the meantime, since he's not a paying tenant, you inform him that you will be doing repairs around the house as needed.
