Well it will probably take a bit more than 3 weeks, since you will probably need to give him 30 days WRITTEN notice to vacate. If he still won't budge, then you file for an eviction order. In the meantime, since he's not a paying tenant, you inform him that you will be doing repairs around the house as needed.
