    What do the circumstances have to be to file Child Abandonment?
    I had my son at the age of 18 and for almost a year I raised him by myself. When I gave birth to him his "donor" was not there and of course did not sign the birth certificate. Well, I ended up giving him the benefit of the doubt and we went to the court house right before my son turned a year old and we changed his last name to have his "donors" name and now he is on the birth certificate. My son will be 5 in September. Me and his "donor" split up 2 years ago and when I got into another relationship we tried to do the right thing by still taking my son around the "donors" family and him also. Well, it didn't work out that way. My son now thinks that my boyfriend now is his daddy. He does not know any different. I filed for Child Support and the "donor" started a whole lot of stuff and told me "I would rather sit in jail than pay child support". So, I cancelled it and we didn't even go to court. Well, he has not seen my son in almost 2 years now and not contacted him or anything. I called and asked him to sign his rights over willingly to me so that I could change my sons llast name. He is not "voluntarily" willing to do that. I don't know what to do. He doesn't have anything to do with our son and never will. He has never paid a dime and never will. He just doesn't want the man that I am with to have custody of him. I know that if I take him to court he will try to get visitation and everything else. He has went to jail for drugs and all other things also. His parents whom he lives with are pill heads, his step dad is a convicted felon. Drugs are all in his family. I don't know what to do. Please help me!

    He does not owe any child support since you did not go to court and get a court order. So he is not a dead beat since he has no past due support.

    And no you don't know what he will do, most likely threaten to do a lot more. But if he wanted to see the child he would.

    And if he will not sign for your new husband ( normally has to be husband) to adopt the child, most likely it will not happen.

    You need to file for child support and let what will happen, happen.

    I just do not want him in wanchilds life because he does do drugs and so does his family. I don't want that around my son. He has not wanted anything to do with him since he has been born. It's not fair to my son.
