    How can my husband adopt my son?
    Ok my husband has been taking care of and providing for my son since he was 2 yrs old. His bio father doesn't call, send child support and has only seen him about 5 or 6 times since our divorce in 2007.My son calls my husband daddy even though he knows he isn't his real dad.He is a real father to my son and I want to make him his legal father.My ex-husband does have joint custudy of our son,but he never calls or anything.What do you think we can do??

    If your ex husband will not willingly give up his rights so that your current husband can adopt---there's not much you CAN do.

    If he WILL give up his rights, then you get a lawyer, have the ex's rights voluntarily relinquished, and file adoption papers with the courts.

    I'm not sure if he will give his rights up or not.I don't know his number or where he lives all I know is the town he lives in.

    You will need to get the bio father to relinquish his rights or may a good faith effort to try. What constitutes a good faith effort will be up to your local courts.

    So the bottom line here is to start shopping around for an attorney who can prepare all the paperwork and filings for you.
