    HIPAA doctors with holding medical records
    My mother recently passed away after complications after a surgery. I'm consulting attorneys and have requested medical records from the surgeons office. After a month, the records are still pending because the doctor has not signed off on his notes. I was told he is probably revising or adding to them which does not seen right. My mother did not get a "do over". QUESTION: Is there a timeframe that the doctors needs to turn over a copy of the records?

    This has nothing to do with HIPAA.

    The Doctor is allowed a "reasonable" time frame in which to finish and provide medical records - in the case of my late husband it took over six months because of his long hospitalization. He also died following surgery.

    And in the case of your mother, unless you were already in writing, allowed by mother to see medical records, acting in the position as the head of the estate.
