I moved to Indiana from out of state last August. I signed a one year lease. In the first month that we moved in there were problems with the septic tank. Since then, every 4-6 weeks the septic tank fills and our plumbing backs up. The landlord then has someone come out and empty the tank. The landlord did not tell us anything about a problem with the septic tank when we moved in. This has become quite a nuisance. The person that comes to empty the septic tank says that the fingers are broken and the whole tank needs to be replaced. The landlord said that we had to wait until the Spring to have the tank replaced. Come to find out that they actually pulled a permit with the county to fix the problem a year ago February, but they are saying that they didn't know before hand. I would like to move out of the property to somewhere without so many problems? What are my rights?

It may be possible but the next time it happens with the septic. Call the health Department in your area. They may be able to help by condeming the system and the owner either fixes it or has to release you. It would be illegal to rent a condemed home for health reasons.

As the landlord for a specific date for the repair. Since it is spring.
Give them a certified letter that this problem is a health risk and needs to be fixed.

BUT, you will not know if the court accepts this as a reason until the landlord sues you and you end up in court

Now I find out that the same house is infested with termites!! I want out - surely between the septic tank and the termites I should be able to break the lease?
