    Custody of unborn children in australia
    My daughters friends girlfriend is preganant and wants an abortion only because she carnt go out partying the father wants the baby and wants to know if he can stop her from aborting the child

    Please pay more attention to posting guidelines. There is a Read First sticky in the Children forum (where this was moved from) that directs questions of a legal nature to this forum.

    In the US, its almost definite that he cannot. Not sure about Aussie laws though. In any case, he will need an attorney to file the paperwork. So he should consult with an local attorney (solicitor?) to find out his chances.

    In my own opinion, it is her body and her decision. Unless he gets some kind of court order barring her from having an abortion, which I don't think he can't do very much of anything unless they are married.

    Then there is the ultimate question. Is the baby surely his? This raises roadblocks as well. Then we get into DNA testing which is paid by the person requesting the procedure, which I don't think can be done until a certain time and can it be done via amnio centesis which is drawing off amniotic fluid ? If in fact, DNA can be determined by that alone or does it have to be a blood sample which would be impossible under the circumstances.

    Yes, questions, out of curiousity but many things to be considered if he wants 'his' baby,

    Yes, before any court in the world will block the abortion (assuming abortion is allowed), there would have to be a DNA test to determine paternity. And that's not a normal procedure for a fetus. So it would probably be difficult to get that done. Without that he hasn't a prayer.
