    Dual residency federal tax
    Hi,

    I came to US in Nov 2009. Previously I was in US from Jul 2007 to Oct 2008.
    Will I have to file my tax as Dual Status for 2009? Do I have fill 1040NR-EZ also?

    You visa? Unless you have visa that exempts you from residency:
    Count 1/6 days in 2007 plus 1/3 days in 2008 and days in 2009. If the total is 183 or more, you will file resident tax return for 2009. Report worldwide income on your tax return.

    My visa is L1 and I was in US for 183 days in the last 3 years. So I don't have to submit 1040NR-EZ (for dual residency status). I can just file the normal 1040 for tax returns. Is that right?

    Yes, if you complete SPT in 2009, you can file resident tax return.
