I leased a room in my house (that I own) to someone that needed a place on short notice. She would not sign a lease agreement. I want her OUT. We do not get along. I asked her for her rent 2 days ahead because I was going out of town. My ? Is can legally change the rent due date when there was no written agreement in the first place? We got into a shoving match over it and I called the police. I declined to have her arrested but now I am having second thoughts because now she is REALLY being a -----. Per a verbal agreement she paid half the rent on the 5th and the other on the 20th. Thank you for your help. Diana

In the absence of a written and signed lease she is on a month to month basis. Therefore, send her or hand her a letter (in front of witnesses) that gives her 30 days to move out. If she isn't out within the 30 days start eviction proceedings.
