    When can I apply for H1 after J1term completion
    I was on j2 Visa and working as a research scientist. Two years home residency rule apply on us. After finishing my term of J2 I came back to my country because my husband didn't try for J1 waiver. On September 14, 2010 we will finish our requirement of 2 year home country stay and would be eligible to work in USA. I have job offer from University in USA as a scientist. Do I need to wait up to 14 September 2010 to apply for H1 Visa or I can start my process in May or June 2010, as H1 Visa process takes 4-5 or 6 months, so as soon as I will finish 2 years my H1 Visa will be ready and I would join the job
    Can I start process of H1 Visa before finishing of 2 years to save time. Thank you in anticipation.

    Applications for H-1 are accepted only once a year in April. Procedures take months prior to that, especially right now DOL takes slow steps on approving cases. You should discuss all details with your employer.
