    Can a dealer sell a used car with bad brakes in NC?
    I bought a used car from a dealership in wilmington nc. The whole thing has been the worst experience ever, then today I heard the brakes grinding. There is a 3000 mile warranty on it and I am under the milage. Are they responsible for fixing the brakes?

    What year and did you pay over a couple thousand for it? If so it falls under the lemon law. But your warrantee should cover it unless you drive it the 3000 miles before you get it back to them.
    Are you sure they are grinding as in wore out?
    Sometimes brand new brakes will make a screechy noise that sounds bad.

    Unfortunately, new cars are eligible for the lemon law, used cars are not. The OP is talking about a used car.

    Also, brakes are considered a wear out part and are not covered under the lemon law.

    And if it is covered or not covered depends on what level or type of warranty was given, many are very limited, others better.

    And of course to be rude and blunt, if you would have had the car inspected as anyone should when buying a car, you would have known this.

    Yeah I should have had it inspected but I was kind of overwhelmed and blind sided by all of this. I paid $12,000 for the car from a "reputable" dealer. I am a college student and really don't have the money for brakes. I just put 3,000 down on the car. It being the holidays and all, I really have no money to get them fixed. I just was wondering if they should do it. Also, this has been the worst experience buying a car I have ever gone through. They tried to up my interest rate 7 points, tried to get me to sign a paper that moved my unlimited warranty to a 60,000 mile warranty at the same price and did so by telling me to "sign here" without telling me what I was signing. I still do not have the title and cannot register it until I have it, running on paper temp plates right now. They sent the wrong contract to Wachovia and fixed it 3 business days before the due date of Dec 29th. When I signed the new contract they dated it back to the original date, even though the amount changed. I have had to go back 4 or 5 times to sign all the paperwork and now the brakes are bad. I just need some help.

    Almost never are brake pads covered by any warranty, If this warranty is done by and though the dealer, they may do it, or do it at a discount.
    But I really doubt it, if I had to bet. Since brakes is a wear and tear item that often needs to be replaced.

    And of course you got almost 3000 miles in wear before the pads went bad, so they may have shown worn but usable even if you had it inspected.

    Next you can't afford NOT to fix it, since if you let it grind it does not take long to go from a 100 dollar repair, to a 500 dollar repair as other parts start to get damaged

    Overwhelmed? Blind-sided?
    We don't know why the brakes didn't get inspected by "your guys" before purchase.
    You approved the deal. I don't know what you would have gone back "4 or 5 times" for to sign?
