Security deposit
My girlfriend and I just moved out of a rental home we vaccumed, and scrubbed the floors, raked leaves, and the normal things that would be done before you move. We requested the landlord do the inspection of the home with us present, he insisted he wanted to do it alone, which didn't make sense to us so we told him were staying for the inspection. He proceeded with the inspection, the walls were a bit dusty but it was from the furnace, that wasn't our fault we changed the filters like they were supposed to, in the upstairs bedroom you could see the dark spots where the nails in the 2by4s were showing through the paint and he kind of tried to blame that on us, that is also not our fault. We proceeded to the basement and we brought to his attention a few small tares in the carpet but he didn't make any fuss about it.. After the inspection was over with he told us the house looked fine he was going to paint the walls mind you we were in the house for almost three years so the inside of the home needed to be painted anyway, the paint was a light gloss so every time anyone would lean on the wall it would leave a handprint! Anyway he told us the home looked fine and wanted us to leave an address to send the security deposit to, and we were thinking OK were getting our deposit back. A week and a half went by and we wanted to pick up our remaining mail, so I gave the landlord a call requesting the remaining mail, he said no problem and then decided to tell me by the way there isn't going to be a deposit cause he said we were supposed to wash the walls, there was nothing in our contract syaing we have to wash and paint the walls before we leave, and the few tears in the basement carpet was within a five foot section not all over place. We gave him 1,050 for a security deposit. I plan on taking him to small claims for the deposit we also have pictures showing the stain where the dust was over the vents and the few tiny holes, we also had dogs and he knew this and he was in the home a few times before not to long before we moved also and said wow can't even tell you even have dogs, doesn't even smell at all. Now that were gone supposably when the furnace kicks on it somehow smells like dog and the home looks terrible.. Do I have rights or a case.

Let me know if it does, but we need to know everything from the git go.

So verbally doesn't mean anything? It has to be written? Its already been two weeks I don't know the rental laws in Michigan but I know he has thirty days and its been two weeks already and yes this thread has a little more info. Sorry first time being on here

Also there was a check list handede out before the walk through and he refused to sign the checklist cause he wanted to walk through the house by his-self. I don't understand why he would pull this after he said everything was fine, we found out yesterday by a friend that he's taken evry one of his tenants to small claims. I have a witness that was there during the walk through. Am I responsible for dirty walls from a furnace?

Sure. Did you use the heat that the furnace made?
It doesn't matter how many times he's sued his tenants in the past. It only matters how YOU deal with him today. Fortunately, you found me, and I'm a MEAN SOB.

Did he sign the checklist after the walkthru? I see no problem with his not signing the check list before inspecting,
As to dirty walls. Doesn't matter why the walls were dirty, you should have cleaned them.

Ok I'm supposed to clean the walls from the basement to the upstairs bedroom? It wasn't that kind of paint you could wash, it smeared and made things look worse when we tried, and how would I be responsible for his defective furnace?

And we told him before something was wrong with the furnace, but I understand you all are giving me advice and some of it is a help but me being responsible for the furnace dust, NOPE.

Look. We weren't there, and you haven't given us much information... But, from what you say, this situation is going to wind up in court anyway, so what the Padre and I say doesn't matter. What matters is what the judge says.
So, wait for the letter. You can't sue him anyway before then... Relax.. Have a cold one. We'll still help you.
