My girlfriend and I just moved out of a rental home we vaccumed, and scrubbed the floors, raked leaves, and the normal things that would be done before you move. We requested the landlord do the inspection of the home with us present, he insisted he wanted to do it alone, which didn't make sense to us so we told him were staying for the inspection. He proceeded with the inspection, the walls were a bit dusty but it was from the furnace, that wasn't our fault we changed the filters like they were supposed to, in the upstairs bedroom you could see the dark spots where the nails in the 2by4s were showing through the paint and he kind of tried to blame that on us, that is also not our fault. We proceeded to the basement and we brought to his attention a few small tares in the carpet but he didn't make any fuss about it.. After the inspection was over with he told us the house looked fine he was going to paint the walls mind you we were in the house for almost three years so the inside of the home needed to be painted anyway, the paint was a light gloss so every time anyone would lean on the wall it would leave a handprint! Anyway he told us the home looked fine and wanted us to leave an address to send the security deposit to, and we were thinking OK were getting our deposit back. A week and a half went by and we wanted to pick up our remaining mail, so I gave the landlord a call requesting the remaining mail, he said no problem and then decided to tell me by the way there isn't going to be a deposit cause he said we were supposed to wash the walls, there was nothing in our contract syaing we have to wash and paint the walls before we leave, and the few tears in the basement carpet was within a five foot section not all over place. We gave him 1,050 for a security deposit. I plan on taking him to small claims for the deposit we also have pictures showing the stain where the dust was over the vents and the few tiny holes, we also had dogs and he knew this and he was in the home a few times before not to long before we moved also and said wow can't even tell you even have dogs, doesn't even smell at all. Now that were gone supposably when the furnace kicks on it somehow smells like dog and the home looks terrible.. Do I have rights or a case.
