    Severing my sons biological fathers rights.
    My son almost 2 years of age, his father is currently in prison for the second time, he was incarercated when my son was born and after his first release he had repeat parolle violations and a domestic simple assault against me. He is now serving time for abscounding and apparently another assault. While incarerated this second time he attacked another inmate putting him in hospital in critical condition. Since he is a violent person and a risk to my son and I, how would I go about having parental rights terminated? He is not on my son's birth certificate and only has our dna test results. What are my chances and prices to get these rights taken away? Also, I was told I could charge him with a form of child neglect and child abondenment.

    Your chances are average and the price is significant. You probably cannot have him charged with neglect or abandonment.

    You will need a lawyer to do this and it is not for certain that his rights will be stripped. You can, however, have a custody order put in place that gives him no visitation or legal say. That keeps support in place while keeping your child away.

    Bottom line, you are going to need a lawyer and be prepared to pay because a TPR is not a simple, inexpensive process.

    In your circumstances I think your chances are a little better than average. With his record of violence, it shouldn't be too hard to convince a court he is a danger. And I'm not sure you even need a lawyer in this case, unless he fights it by getting his own lawyer.

    At the very least you should be able to prevent him from obtaining any visitation with the child.
