    My daughter was born August 29 2009, can I file for her child tax credit this year?

    If you are a U.S. citizen or resident and the child is U.S. citizen or resident, you can claim child tax credit.

    If you and/or your spouse are in the U.S. on a work visa, then you can file jointly and claim your child as a dependent, which makes her eligible for the Child Tax Credit.

    If you or your spouse are here on a F-1 or J-1 visa, then you cannot file jointly, nor can you or your spouse claim the other parent OR the child as a dependent.

    However, the parent who is on the F-1 visa who has earned a taxable salary CAN claim the Child Tax Credit for your daughter if your daughter was born in the U.S. and is, by law, considered to be a U.S. citizen. This can be done by filing Form 8901 with Form 1040NR.
