    Hello my husband wants to adopt my son
    My Son is 7 years old and his father has never been in his life, he didn't sign the birth certificate or anything and when I got married my husband talked about adopting my son since my son knows no better he's been calling my husband daddy since he could talk so I was wondering if anyone knows how to go about it? How much it would cost? I have no idea how to even proceed to do this so if anyone could help that would be nice!

    Your husband needs to file to adopt the child BUT the child's father needs to give written consent in order for the adoption to be approved. Attorney fees vary from State to State, City to City, and you may want to call several Attorneys and ask for a price.

    He's not on the birth certificate so he has no rights to him so I don't understand why I would have to track him now since he hasn't been in his life for 7 years I'm just scared if anything happens to me he doesn't go to the state I want him to be able to stay with my husband.

    He doesn't have to be on the birth certificate to have rights to him. He shares DNA with your child.
    In order for an adoption to be granted you would need the biological father's permission (which should not be difficult as he has not shown any interest in the child's life).

    The Law says that the way it works - he's the child's father and, as such, he has legal rights whether he cares to use them or not. If he has no interest in the child he very well may happily sign, particularly if he's told if he DOESN'T you will file and enforce child support.

    I understand your concern about what will happen to the child if something happens to you and that is always a danger when parents are not married and/or (minimally) living together.
