    MIP/Consumption
    My 19-year old son has received a summons to appear in court for MIP/Consumption of Alcohol by a minor. We have never been to court for anything. I will accompany him. What should we expect? Are there questions we should ask? Will he have a "record?" I'd appreciate any help you can give us. Thank you.

    A lot hinges on the specific circumstances involved. Is he guilty or not guilty? Receiving a summons is not the same as being legally guilty. Is there any potential that he could be defended to the extent that he can't be proven guilty beyond any reasonable doubt? What concrete evidence does the state plan to present at trial? Have you retained or consulted with an attorney? If he is convicted, then yes, he will have a "record." As for a sentence, assuming this is a first offense, he'll probably get probation and/or community service, along with probable loss of driver's license for at least 1 year.

    I had an MIC when I was 19 years old and I lived in Kansas. I first got an attorney to get the least possible sentence. My punishment was a 400 dollar fine and probation for a year and a restricted licenses for a year. ( I could drive to school and work). This can be taken off your record if you use a diversion on it, I didn't have to because of my attorney.
    P.S. An Attorney would be the best way to go and usually cost 500-1000 retainers fee, remember this will affect your future.
