    How can my ex sign his rights to our daughter away?
    My ex and I have been going through a nasty divorce for three years now and our child is caught in the middle of it. He has never helped in anyway shape or form to support her till child support started garninshing his wage's just recently. Every time she came back from his house there would always be something new wrong with her. She came back with bed bug bites, a bruise that went all the way through her ankle bone, and last year she came back with a swollen private. I took her to the er and they sent me to the childadvicay in my area for a rape kit. The doctor concluded that nothing was broken, thank god, but he couldn't rule out that she was touched. I finally at that point stopped all visitation between him and the child and in stead told him he could come to our home to see her under my supervision. He refused to see her and hasn't seen her since last September. Yesterday he asked me if he could sign his rights to her away. Now my question is how can we go about getting his reights to our daughter signed away and do I have to have like my boyfriend to adopt her before we can have his rights signed away? I feel and so does he that this would be the best course of action for our daughter since she has known my boyfriend for the last 2 years. The only thing that worries me about all this is that I live in North Dakota and he lives in Montana. How can we get this done so he can't just take her and I never see her again?

    Well, to prevent him from taking the child, you get an order of custody that says that you have custody. I assume you already have that since you are in the divorce process.

    As for signing over his rights... unless you are remarried and your HUSBAND wants to adopt, that isn't something he can do.
