Child Support for 20 and 21 year old
Can someone claim child support for children who are now adults, ages 20 and 21? The divorce decree stated no child support required at this time (when the children were 1 and 2). Mother now wants "back" support. As far as I know, no claim was ever filed. Mother claims they didn't know how to find me, however, I was already in the system (another child support case-not related to these children), so the child support agency would know where to find me. Thank you for your answers.

If no claim was ever filed then no, she cannot get back support. Support starts when the support is ordered. As the kids are above the age of majority, new support cannot be ordered.

Its not your fault that she couldn't find you. Support could have been ordered without you.

What state are you in because in some states child support runs until age 21. So it may be possible to get it on the 20 year old depending on circumstances.

I live in NC. The 20 year old lived with me from 16 to 19. Then went to school. Has since dropped out of school and is living in VA with his mother. Thanks for the info!

Child support doesn't go beyond the age of 18 in either of those states. So unless there were circumstances to extend it as in medical needs of the child then there should no longer be any new support orders.
