    Landlord not giving Deposit - Texas
    Hi
    I was residing in a place for 4 months and gave the landlord $500 as deposit. I did a mistake by not signing a contract.

    I moved out last month and when I asked for the deposit, he said he will give it in a day or two. Later, he said he will give it in a week. Now, aware of the fact that a contract was not signed, he said he doesn't owe me any deposit amount.

    Prior to his email saying that he can't pay me the deposit, I had tried to call him several times, left several voicemails, emails and even visited my old place 4-5 times but to no avail.

    The only proof I have is, in all but one check, I have mentioned the month and the rent like JUNE RENT and so on and on the first month, I have "500 deposit" in the memo section of the check. I have got copies of it from the bank.

    What can I do about it. Is there a way to get my deposit back? I am pretty much new and I don't have any idea about it.

    You need to get all your proof the check that states $500. Deposit and any saved emails or answering machine messages he may have left you and take it to court.
    He has to give you a written itemized letter that shows what any deductions were for.
    The lack of a lease only shows you are month to month it doesn't have any bearing on him withholding your deposit.
