    What should I do if my husband won't cooperate with the removal of my conditional per
    Me and my son were granted conditional permanent residency based on my marriage to a U.S. citizen almost two years ago so that means that I have to file for a removal of my conditional permanent residency in like 3 months from now but my husband don't want to cooperate with my application. We're having marital problems but he don't want me to leave. I told him I want a divorce but he said that according to Maryland's law you can't file a divorce unless you were legally separated for a year. So what should I do?

    If your husband is not willing to cooperate with the RC, then you should divorce him.

    Whatever the process is in your state, follow it, complete the divorce and then file the RC requesting a waiver of the joint filing requirement based on marriage entered into in good faith but now divorced. You will need to show that you married for the right reasons, have evidence of cohabitation and co-mingling of funds. Gather this docuemntation now, as it gets problematic as soon as the respondent is served with divorce papers.
