    Transfer of mortgage and Car
    How do I arrange it so that the mortgage is taken over by me without having to buy out my Husband after our divorce

    Is he agreeable to simply giving you his interest in the house? If so get a new loan on the property (if you qualify of course) and have him sign a quitclaim deed.

    Whether you buy out your husband's interest or he just gives it to you as part of the settlement is a matter of negotiation. But the only way you will get his name off the loan is by refinancing. As part of the refinance closing he will sing a quit claim deed over to you.
