Is he agreeable to simply giving you his interest in the house? If so get a new loan on the property (if you qualify of course) and have him sign a quitclaim deed.

Whether you buy out your husband's interest or he just gives it to you as part of the settlement is a matter of negotiation. But the only way you will get his name off the loan is by refinancing. As part of the refinance closing he will sing a quit claim deed over to you.
