Tenant Eviction in Florida
I have been laid off from my job and cannot pay my rent. I am interviewing for a new job and hope to have one soon but my landlord is about to start eviction proceedings. How long do I have in my place (or to come up with my rent) before I can be legally evicted?

If you have not paid your rent, he can give you a 3 day pay or quit notice and then file for an eviction. From all I have been seeing, that will give you about 30 days before you are in court and 3 days after that before the sheriff removes you from the home.

Depends on what you mean by starting eviction? Florida, I believe, starts with a 3 day pay or quit notice. This gives you 3 business days to pay or vacate. If you pay, the process stops, if not, the landlord files for an eviction order.
A hearing then needs to be scheduled. How lkong that takes depends on the court calendar. Considering the economy it may be a couple of weeks. At the hearing the judge will give you a set time to vacate, again that will be up to the judge, but it will proably be a 10-30 time frame.
At any time in the process, you can offer to pay all arrears and have the process stopped.

You will be served with three day notice, after the three day notice a lawsuit will be filed against you, you have 5 days to answer, you must pay the rent due to the court register, if you failed to answer and pay the rent to the court register a default order will be issued against you by the clerk of court and a writ of possession will be entered by the judge, after that you will be served 24 hour notice by the sheriff, a day later you will be avicted and your possessions will be dumped on the street curve

Can you cite the regs for that timing?
