My roommate left a note under my door saying I had 30 days to vacate the property. I tried calling her and she does not answer the phone. I try waiting for her to come home but I can't wait all day because I have to go to work. I pay the rent and the utilities just like the other roommates. Can she just evict me for nothing other than she does not like me? I mean don't I have rights too? I've been here for a year! Only one persons name is on the lease so does that also mean she can kick everyone else out the house when she is having a bad day?? I need help!

If her name is the one listed on the lease, yes, she can evict you for whatever reason, providing you do not have a lease with her.

You do have rights - that's why she has to give you 30 days notice before she can have you formally evicted through a court.

The person who is on the lease is YOUR landlord, you are her tenant. If you do not have a termed lease with her, you are considered a periodic (generally month to month) tenant. This means either of you can terminate the lease with one months notice. In some states the notice has to be one full rental period (i.e if rent is due on 4/1, then notice has to be served prior to 4/1 to be out by 5/1). Or notice could be less than 30 days (i.e. Fl only requires 15 days). Some states (a very few) do require some sort of grounds to terminate the lease, but that's rare.

Sorry, this isn't what you want to hear, but if she wants you out she has the right to terminate your tenancy as long as she gives proper notice.

Is my landlord in violation if she is showing my room without giving me notice? **This by the way is before I got the 30 days notice**

Yes. You should be given at least 24 hours notice... But, what are you going to do about? There's NOTHING you can do.

So how do they know you are moving if you have not given notice??

If they are showing it, that means they are going to rent it to someone else.

Are you behind in rents ? It shoulds like you told them you were moving ( that is giving notice)

But they are suppose to give "reasonable" notice, this is often considered 24 hours.

So there is nothing I can do? Not only can my roommate can go into my room anytime she wants to show my room but she can kick me out because she thinks I ate her bean and cheese burrito and now her "comfort level" is a concern. UNBELIEVABLE!

Looks like a roommate feud, rather than a landlord/tenant issue. They are different. More info with specifics would help people help you.

Please don't start new threads about the same thing. We can't give you an honest answer when you change the circumstances.

Your roommate can kick you out if the lease is only in her name. Does it suck? Of course. But that's the law. You're not entitled to anything because you never signed a lease with the owner of the property.
