MY EX-employer has posted several lies about me on a web forum, because he believes that I said something negative about him on the forum. Can I sue for him telling lies about me, even calling me a whore and a as well as making me look as though I can't pass a background check?

Hello kay:

You could sue him and WIN if you could show damages. Damages are what you can prove his lies cost you. At this point, I don't think you have any.

Well he has damaged me, I have a very unusual name, and this is a very small area. Everyone knows everyone, and everyone talks. He is running for a public office. I get stares and even when I put in an application to do anything, no one will even bother to call me back.

I would contact an employment lawyer in your area.

If you can prove emotional stress and/or the inability to get re-employed at a position of equal value then you may have a case.

It wouldn't hurt to talk to an attorney in your area.

There are three requirements here.

1) You have to prove that HE posted those things. It could have been someone else posing as him.

2) You have to prove that what he said is untrue. Proving a negative is difficult.

3) You have to prove you have been MATERIALLY damaged. Like someone turned you down for a job because of what he said.

Consult an attorney who can tell you whether you pass all three tests.

However, you mentioned that he is running for public office. Write a letter to the editor of your local paper and tell them what type of lying vindictive person he is. Before they publish they will, probably, check the facts. So having that published will exonerate you and probably end his political career.

I am looking for an attorney now. I am new to this area, and don't know anyone. He was privy to my private information. I was his only employee in the office, and so no one was there to have the information that was posted. He says that I was fired from work, because I couldn't pass a background check. I don't even have a speeding ticket on my background. He also talked about my husband, again, no one in this area knows us or our situation, except him, because I had to let him know I would need to go to immigration in a few months. He even posted this, in an attempt to make my husband , and told me to go back to my husbands country. I am thinking to hire someone to find out if he is giving me a bad reference for employment. I hope I can find an attorney here, but I am not sure. All this because he thought I wrote something negative about him on a forum.
