    Writ of garnishment on cd
    I am in Texas need a writ of garnishment on a cd from a judgement I received against her in small claims court how do I go about getting this started

    Small Claims courts are very informal. I found a sample form here:

    Request For Abstract Of Judgment-Writ Of Execution-Texas Local County forms

    Just fill it out and submit to the court. You will then need to hire a process server to serve it on the bank.

    A writ of garnishment is generally applied towards salary or regular income. A writ of execution is used on assets like a CD.

    Turnover form and info
    Explain a form application for turnover please and also how do you seek information on a person for garnishment of a cd or other like stock or annuities she owes me 8000.00 and refuses to pay even though she has collected a sizeable law suit

    You need to take her to court via a lawsuit and get a judgment against her. You cannot garnish a CD or stock or annuities from her. You would get a judgment and then collect on the judgment from her assets.

    In some states this would not be Small Claims court either but Circuit or Superior or Common Pleas Court.

    Ernest there is not turnover form. As I said earlier you must get a judgment in order to collect your money from that individual. There is no other way. File a lawsuit and get a judgment.
