    How can I file a lien if there has been a bankruptsy
    Hello,

    I sold my motorcycle to my brother with a written agrement. He shortly there after filed bankruptcy, but claimed it to where he would still have to pay what he owed in full. Every time he quits or gets laid off, he stops the payments on the bankruptcy and I do not get paid. He has since sold the motorcycle. Can I file a lien against his vehicle to make sure I get my money?

    You can't lien against property someone no longer owns. He had the title to the bike?

    You might be able to take this up with Bankruptcy Court as he MAY have been ordered to turn the proceeds of sale of any of his property over to the Court.

    You would have to see what the documentation says.

    Can I file a lien on his truck instead of the motorcycle? I had a lien on the motorcycle, he got in trouble and needed the cash, I felt sorry for him and let him have the title.

    You can lien against his truck IF AND WHEN you get a Judgment for the money he owes you. You can't simply place a lien for the heck of it.

    You would have to check with Bankruptcy Court first. His filing most probably precluded any type of collection activity.
