    House up for auction hlp!
    Hello to all, and thanks for any help & advice offered :)

    I live in Upstate NY, and I am a renter. Here's the question and situation:

    The landlord to my apt hasn't paid taxes on the house, (but does pay the mortgage)and the city put up a *auction* sign in front of the house just recently. If someone buys this property at the auction, :

    1.) What happens with the security deposit?
    2.) If the property has new owners, am I liable for any "damages?" (there are some damages to the kitchen floor) :(
    3.) Can new owners (if they don't make me leave) tell me that I will have to get rid of my animals? ( I have 2 cats, 1 puppy)
    4.) If the new owners say I have to move out, how long will I have? I am in a very bad financial circumstance. Can I fight it because of the financial situation, I have no money to move.. :eek: (no I'm not on government assistance)


    I have resided here since 2001. The security deposit I paid I believe was 400.

    First I doubt that the house will sell for taxes, normally the mortgage company will come in at the last minute to pay them and add them to the mortgage payment.

    Next if I am correct, they don't actually get the house at the sale, but get a tax certificate, they must keep that for a period ( one year I think) before they can redeem it for the actual house

    But once it does sell for taxes or foreclosure any lease you have would be void, they can then have any new rules they want, higher rent, no pets or even evict you.

    This is the 2nd time the house went up for auction, and 1st time nothing happened, it wasn't bought or anything. But, if it does then what? What happens with security deposit? And what about damages with a new owner?
