    Collecting on a judgement order
    I had taken a person to small claims and won a default judgement for damages to my car. I told the defendant she could wait until tax time to pay it. Well, in 2007 she had trouble with her taxes and had to wait. She ended up receiving her 2007 and 2008 taxes this year and is now not trying to pay for damages. I no that she is not keeping her money in the bank and is not trying to work to avoid money from being taken from her. She just purchased a vehicle this month. So it wouldn't do any good to have a garnishment done. I also wanted to know if there was a way to wait until next year and go to court on intercepting her 2009 taxes through a judge or etc..,. I want her to pay for the damages and the law makes it very hard for people going to small claims. I'm here in the state of Colorado

    No, you can't intercept her taxes for a Small Claims Court Judgment.

    What does her purchasing a car have to do with a garnishment?

    The hard part of Small Claims Court is collecting - as you are finding out.

    If she's had enough money to buy a new car, she will come up with whatever garnishment you can get from her wages. I'd look into getting the garnishment. You sound way too nice to have waited this long for repayment. How was she able to get a new vehicle if she is not working?

    Yes if she is working, and you live in a place that allows a wage garnishment, garnish her paycheck,

    Attach what money there is in their bank account
