    Bankruptcy and how it impacts foreclosure
    I recently filed chapter 7 bankruptcy in the state of Georgia on December of 08; My formal hearing was January 30,2009 at that time the trustee declared no interest in my residence. I have applied for a mortgage modification but have not received approval from my lender as yet. Can they foreclose on my home prior to my charge off date the end of April? Or do these two things have nothing in common at all?

    Welcome to AMHD. What does your attorney say about this? The Trustee is looking for equity that he can seize and pay to unsecured creditors; evidently, the Trustee ascertains no equity. Your discharge date has no significant bearing on whether you will be able to modify the mortgage. I am not familiar with the procedure for obtaining a mortgage modification; are you supposed to be behind on your payments, or current?
