    Can I Sue someone who stole from me to recover my insurance deductable
    We rented a storage locker to warehouse furniture and items from my parents estate.
    We received notice that there was a break-in at the locker. Our first assessment of the site indicates they took a computer.. stereo equipment... and smashed or broke high-end crystal and dinnerware.
    Our home insurance will cover this loss of property... however I will be out the cost of our deductable.
    When the thieves get caught.. (they have video surveillance and finger-prints)... can I sue the thieves for the amount of the deductable?

    It should be tacked on to their sentence as restitution, but you might want to put in a call to the DA's office to remind them.

    You will need to check with the insurance company and the settlement, normally you will receive their payment and they receive the right to sue for their money back, and then if they collect all of it, they return deductable.

    But after that if the court orders it to be repaid, you can keep the deductable amount but have to turn the balance back to the insurance company.

    But I will be honest, even with video I would say most break in are never solved
