    Probation violation.
    My boyfriend is on probation for an act of crime he committed 11 yrs ago. Two years ago his step son died, one that he raised as his own, his probation officer refused to let him leave the state to bury his 18 yr old son, but he went any way. He went back after only being gone for 2 days. When he returned back he found that his girlfriend at the time was sleeping with another man and got into a fight with the man. This caused him to get assult charges brought up on him. He then got scared that he was going to go to prison and left the area completely. He was arrested the other night and is in county jail under a misdemeanor and cannot be release on bail. Can someone tell me if he got a good lawyer could he fight this in court? Will it be a long time before we are together again? This is tearing me up inside. Can someone please answer?

    Sounds like he was picked up on an open warrant. He was on probation; he asked permission to leave the State and that permission was denied; he left the State anyway; he went back "home" and assaulted someone; he then fled.

    I'm sorry but I don't see any possible defense to this.

    He was on probation and didn't follow the terms of probation in at least two ways - he left the State and he was arrested again.

    He then fled the State to avoid the assault charge.

    I doubt the Court will believe he can be trusted to follow the rules of probation now.

    More than likely he will be spending some time in jail as he essentially is an escapee. He's already proved he doesn't play by the rules so I doubt he will be given more probation time to mess up some more.
