    Signing rights over
    My ex-boyfriend, I think is going to make it very difficult for me to get child support. I have a hearing on Feb. 10th. I have a feeling he may want to sign his rights over, just so he does not have to pay. I need to know what the procedure is, and what all it means. I don't know if it is the right thing to do, but he has not seen his son in almost 2 months and has not called either. Do we have to go to court? Does he still have finanical responsibility? Can you help me out?

    He cannot sign over his rights and he will continue to have a financial responsibility for the next 18 years or so.

    Yes, you will have to go to court.

    If you want child support, then you have to go to court. Like steve pointed out, your ex can't just sign away his rights; most courts will require for there to be another party willing to adopt the child before a parent can sign away their rights.

    The court will require a DNA test to be performed to establish your ex as the legal father. Once they get the results, he will be ordered to pay support but he will also be entitled to visitation.
