    How do you evict stepdaughter from home when her father is against the idea?
    Hi, my 21 year old stepdaughter quit a job out of state and asked my husband if she could move back into our house with her 2 yr old old son to take a 2 month course that would help her get a better paying job. He agreed and told me she was coming back as he was on his way to pick her up from the train station. We have had lots of trouble with her in the past along with her mother and had to put her out twice.

    I told him okay as long as he followed through and did not allow this to become long-term situation. After living with us for one week we found out she was pregnant with another kid that she an boyfriend intends to have. Keep in mind the boyfriend does not provide any support and she refuses to file for child support with the state.

    During the two months that she has lived with us, it has been pure hell. She does not like to clean behind herself or her child. After I got onto her about her uncleanliness, she decided she was just going to get a job and move out. She got fired from one and just started another job that barely calls her in to work. I blew up last week and told my husband and her that I wanted her out by December 15th. The plan was to take a course that might help get a more stable job and that she has not happened.

    She explained she never wanted to go to school, she only said it because she thought it would please us. During this family argument/discussion, she explained she really wanted to pursue singer as a career. She also told me there was no way in hell she would leave the house if her dad didn’t tell her she had to. He is insistent on allowing her to stay through late January.

    I have had it with both of them, he does not discuss these issues unless I bring them up to both of them. As you can see, I have more than just a stepdaughter problem in my house. How do I get rid of her and her son? I want to start the evicition process, however, would a judge honor my request if my husband shows up and says otherwise?

    Are you the owner of the home? If it's not your house (i.e. it's in your husband's name) then it's his choice. Even if you and your husband are joint owners of the home I doubt that you can evict the step-daughter against his wishes. Your problems seem to be as much with him as with her.

    Yes, we are co-owners and we have two wonderful kids together, 7 and 9 yr old girl and boy. Teaching them the importance of household and personal responsibility is somewhat challenging while she is in the house. I rather loose the house than stay, I guess my only alternative at this point is to make plans to channel all of my income towards a permanent move elsewhere with my kids. Thanks
