    Domestic Violence and Unlawful Restraint
    Hello,
    I just have a couple of questions that I'm hoping someone can help me with. My boyfriend and I have been together for a few years and I never thought the day would come where he would hit me and keep me hostage in my own house but, it did. So, I went to the hospital after the incident and the hospital called the police. They showed up took pictures and so on and so forth. Well, I have court on Wednesday. I don't know how to go about it though. Do I get an attorney or not? The problem is too that we have a little girl together. I don't want him going to jail or prison or whatever for 2 years. That's what I've heard word on the street. I don't want her to not be able to see him at least once every few weeks you know? It would hurt so bad for her to be without a father. I know a lot of people reading this are going to be like well you know do you want her to be around someone like that. Honestly though I just want supervised visitation. Anyway, do I have any say at all in court? Can I ask the judge of certain things from my boyfriend? Like, drug tests and counseling? Do you think he will even go to jail? Or prison for that matter? If he does how long do people with those charges normally go for? See, he had a bond of 3,000 and someone went to a bail bonds man (not sure if that's the "correct" term). He was only in jail for like 2 days maybe. But yeah he has 2 counts of unlawful restraint and one for domestic violence. Pleasee someone gimmie the 411 cause I am so confused on the whole situation and I really don't know what to do.

    He's going to have to do some time if he essentially kidnapped you and beat you up. There is no way around this if the hospital has pictures of you all beaten up and a police report to go along with it. You won't be able to put your "requests" in to the judge until he is sentenced. You are getting way ahead of yourself here. If someone did that to me I would want them to spend every minute of 2 years in jail for it regardless if I had a kid to them or not. He is only going to get more and more violent towards you and possibly start in on your kid as well. She is not going to miss anyone, believe me. He needs the attorney, not you at this point.

    Right now you're just having a huge case of guility conscience that HE is in jail. Get over it. He's where he belongs.

    I have to say, you should not want him any where near your child, do you want him hitting the child or maybe keeping the child from you and not returning the childd?

    This sounds like the couple next door to me, the lady stabbed the man in his sleep, I found him on the steps bleeding after he got out of the apartment, I called the police and paramedics. Well today, he is trying to make her bail, and worried about her being evicted. What the heck??

    But no, you are a witness you do not get an attorney, and no you do not get to ask or talk to the judge about anything.

    The DA and the defense attorney will question you, and you will tell them what happened.

    To be honest I hope you do leave him, get a restraining order to keep him away from you and the child.
