    Paternity name change
    My son is 15 and when I was pregnant with him I broke up with the biological father and married my ex-boyfriend. When he was born he was given my husbands name and he was named as the father on the birth certificate. My son has now met his biological father and wants to take his name. What do I need to do and is it even possible?

    Your husband is his legal father. By marrying you and signing the because, he took on the role and responsibility of legal parent. Therefore, you cannot change his name legally without the legal father's consent.

    He can wait until he's 18 and file a petition in Family Court to effect the name change. Or you can file a petition on his behalf to do it now, assuming his legal (and, In my opinion, real) father agrees.
