My husband has a grandmother that has just been declared mentally unstable, a call that should have been made about 5 years ago. She is being forced into a home by the police. She does have a POA, and my husband and I were curious as to what happens to all of her belongings i.e her car, two residences, things of that nature. We don't want it going to the state and we are unsure of what might happen when she is put into the home. Her POA is not a family relative because most of husband's aunts, uncles and mother included don't have anything to do with his grandmother and are too irresponsible to take over her belongings.

A POA entitles the holder to sign legal documents for a person. But that's all. If she is being committed, the state should be appointing a guardian. That guardian would be responsible for managing her assets and belongings.

Scott is right that the guardian would be responsible for her assets. I have seen things of this nature be sold to pay for the care of the person.

What state is this happening in ? Its too late to do anything about it now because she has been declared unstable but you might need to check and see if maybe she wrote up a trust before she went in. If so then that may allow for protection of her assets but if its just a simple will or anything like that unless someone is named for this type of event then the state may take everything for hospital charges.
